The construction of domestic dwellings and associated work is governed by the Domestic Building Construction Act 1995 (VIC)(“the DBCA”) and it includes the removal or demolition of a domestic building.
The DBCA provides a framework for a number of prescribed clauses to be included in every contract for domestic building work that exceeds a value of $5,000.00 – these clauses, provide for the following general categories:-
- the warranty of quality of the building work;
- insurance for work exceeding a value of $10,000.00;
- limits on the amount of deposits payable;
- restrictions on the increases of building price/costs;
- access to the building site;
- inclusion/exclusion of certain fixtures and fittings/services;
- registration of the building practitioner;
- cooling off period after signing of contract;
- termination of domestic building contracts; and
- dispute resolution – conciliation/ Victorian Civil and Administrative Tribunal
